Legal situation when booking a hotel room

 

Cancellation policy

Dear guest,

If you cancel up to 4 weeks before arrival, we generally charge no cancellation fees.

Our tip:
Who can see into the future? So please remember your cancellation insurance or take advantage of our own cancellation fee (45 € per booked room / flat)!
With this flat rate, you can cancel your booking up to 5 days before arrival – regardless of the reason for cancellation – free of charge.

Please note that the package must be cancelled within 10 days of booking and at least 4 weeks before arrival.

General terms and conditions

    1. Conclusion of the guest accommodation contract
      If a hotel room is ordered, confirmed or provided at short notice in writing, verbally or by telephone, a guest accommodation contract is concluded.

    2. Obligations arising from the guest accommodation contract
      The conclusion of the guest accommodation contract obliges both contractual partners to fulfil their mutual obligations for the entire duration of the contract.

      a) Obligations of the landlord
      The landlord is obliged to keep the room ready in accordance with the order.

      b) Obligations of the guest
      The guest is obliged to pay the price for the time (duration) of the hotel room booking.

    3. Non-utilisation of the room
      If a guest does not use the booked hotel room, they remain legally obliged to pay the price for the agreed hotel service – regardless of the reason for their non-utilisation. Only actual savings made by the establishment are to be deducted (Section 537 (1) BGB).

    4. Amount of savings (according to DEHOGA)

      • Apartments: 10 %

      • Overnight stay with breakfast: 20 %

      • Half-board agreements: 30 %
        of the agreed price in each case.

    5. Renting out
      If the landlord is able to let the unused room to someone else, the guest is not obliged to pay the amount of the income generated for this.

    6. Payment terms and lien
      The landlord is entitled to cash payment for all services before departure and accordingly has a legal lien on the guest’s items brought in.

 

  • Jurisdiction
    The place of jurisdiction is the place of business, as the services arising from the guest accommodation contract – even in the event of non-utilisation of the room – are to be provided at the place of business.
